1. Agreement, Parties, and Acceptance
This User Agreement and End User License Agreement (the "Agreement") is between you and Rovly ("Rovly," "we," "us," or "our"), not Apple. It applies to the Rovly mobile application, coffee brewing guides, bean learning features, brew logs, tasting notes, user-generated content features, paid digital features, support services, and related services that link to this Agreement (collectively, the "Service").
By installing, accessing, registering for, purchasing through, submitting content to, or using Rovly, you agree to this Agreement and acknowledge the Rovly Privacy Policy. If you do not agree, you must not install, access, purchase, or use Rovly.
2. Adult Use Only
Rovly is only for users who are 18 years of age or older. By using Rovly, you represent and warrant that you are at least 18 years old and legally able to enter this Agreement.
We may deny access, remove content, suspend accounts, or terminate accounts if we believe the age requirement has been violated.
3. App License
Subject to your compliance with this Agreement, Rovly grants you a limited, personal, revocable, non-exclusive, non-transferable license to download, install, and use the app on Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions and applicable App Store usage rules.
The app is licensed, not sold. All rights not expressly granted are reserved by Rovly and its licensors.
4. Coffee Brewing, Coffee Bean Learning, and Personal Responsibility
Rovly may provide coffee bean education, roast explanations, brewing recipes, grind suggestions, water-temperature notes, tasting prompts, and user-submitted coffee content. These features are informational and organizational only.
Caffeine and preparation notice: Rovly is not a medical, nutrition, allergy, pregnancy-health, or caffeine-safety advisory service. Brewing results vary by equipment, water, beans, grinder, temperature, user skill, and personal tolerance. Hot water, steam, grinders, and coffee equipment can cause injury if misused. Use safe preparation practices and consult a qualified professional if caffeine may affect your health.
You are responsible for your ingredient choices, caffeine intake, equipment handling, and personal judgment. Rovly cannot guarantee brewing results, taste outcomes, health outcomes, or safe use of coffee equipment.
5. Account Duties
- Provide accurate account information and keep it updated.
- Protect your login credentials and do not share your account without authorization.
- Use Rovly only for lawful, personal, and permitted purposes.
- Do not bypass age checks, security controls, moderation tools, payment systems, or account restrictions.
- Notify us at rovly@rovlyit.com if you believe your account has been compromised.
6. Restrictions on App Use
You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, disassemble, attempt to derive source code from, or create derivative works based on the app or Service, except where such restrictions are prohibited by law.
You may not use unauthorized bots, crawlers, scraping tools, automation, malware, exploits, or any method that interferes with the Service or another user's experience.
7. User Content and License
"User Content" means any content that a user creates, uploads, posts, submits, sends, stores, displays, reports, or otherwise makes available through Rovly, including brew recipes, bean reviews, tasting notes, comments, photos, messages, reports, appeals, and profile information.
You retain ownership of your User Content. By submitting User Content, you grant Rovly a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, process, adapt, modify, publish, display, distribute, translate, remove, restrict, and otherwise use your User Content as needed to operate, provide, improve, promote, protect, and moderate the Service and enforce this Agreement.
You represent that you have all rights necessary to submit your User Content and that it does not violate this Agreement, any law, or any third-party rights.
8. Zero Tolerance for Objectionable Content and Abusive Users
Rovly has no tolerance for objectionable content or abusive users. You may not post, upload, share, promote, request, encourage, or facilitate content or conduct that is illegal, harmful, abusive, offensive, unsafe, discriminatory, disturbing, or inconsistent with this Agreement.
- You may not post fraud, scams, spam, phishing, malware, illegal activity, or unsafe commercial activity.
- You may not exploit, identify, bully, sexualize, or endanger minors, even though Rovly is for adults only.
- You may not infringe copyrights, trademarks, privacy rights, publicity rights, trade secrets, or other rights.
- You may not disguise prohibited content as coffee reviews, brewing notes, bean discussions, photos, comments, or profile content.
9. Reporting and Blocking
You may report objectionable content or abusive users through in-app reporting tools where available or by emailing rovly@rovlyit.com. Reports should include enough detail for review, such as usernames, links, screenshots, dates, descriptions, and the reason for the report.
Where interaction features are available, Rovly provides or may provide tools to block abusive users. Blocking may limit comments, messages, profile visibility, or other interactions depending on the feature.
10. Moderation and Enforcement
We may use automated tools, manual review, content filters, safety signals, account history, user reports, and other measures. We may remove content, limit visibility, disable features, issue warnings, suspend or terminate accounts, block access, preserve evidence, notify affected users, or report matters to authorities where appropriate.
11. In-App Purchases, Subscriptions, and Purchase Information
Rovly may offer paid digital content or functionality, such as premium brewing guides, bean education collections, tasting tools, advanced recipe features, subscriptions, or other in-app purchases. Purchases of digital content or digital services inside the app must be completed through Apple's in-app purchase system unless Apple rules allow another method.
Before you complete an in-app purchase, the App Store purchase screen will show important purchase information, which may include product name, price, subscription period, renewal terms, billing frequency, free trial terms if any, and confirmation that payment will be charged to your Apple ID.
If a subscription is offered, it may automatically renew unless canceled at least 24 hours before the end of the current subscription period or as otherwise stated by Apple. You can manage or cancel subscriptions in your Apple ID account settings. Refund requests are handled by Apple according to Apple's policies.
12. App Tracking Transparency
If Rovly seeks to track your activity across other companies' apps or websites for advertising, advertising measurement, or similar purposes, Rovly will request permission through Apple's App Tracking Transparency framework where required.
The App Tracking Transparency description may state: "Rovly would like permission to track your activity across other companies' apps and websites to personalize coffee-related ads, measure advertising performance, and improve the brewing and coffee bean learning experience."
13. Privacy Choices
Rovly's Privacy Policy explains how information is collected and used. Your acceptance of this Agreement does not replace any separate consent required for tracking, marketing, cookies, notifications, or privacy choices under applicable law or Apple rules.
14. Intellectual Property and Feedback
Rovly's software, design, names, logos, interface, brewing guides, bean education content, and other materials are owned by Rovly or its licensors. You may not use Rovly branding without permission.
If you provide feedback, suggestions, bug reports, or ideas, you grant Rovly a perpetual, irrevocable, worldwide, royalty-free right to use them without restriction or compensation, unless prohibited by law.
15. Third-Party Services
Rovly may contain or rely on third-party services, including Apple services, hosting, analytics, crash reporting, payment entitlement services, or user-shared links. Third-party services may have separate terms and privacy policies. Rovly is not responsible for third-party services except where required by law.
16. Support, Warranty, Claims, and Apple Terms
Rovly is responsible for providing support and maintenance for the Service only as described in this Agreement or as required by applicable law. Apple has no obligation to provide maintenance or support for Rovly.
To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind. Rovly disclaims warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, availability, security, and non-infringement.
Rovly, not Apple, is responsible for addressing claims relating to the Service or your possession or use of the app, including product liability claims, regulatory claims, consumer protection claims, privacy claims, and intellectual property claims, except to the extent otherwise required by law.
You and Rovly acknowledge that this Agreement is between you and Rovly only, not Apple. Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance of this Agreement, Apple will have the right to enforce this Agreement against you as a third-party beneficiary.
17. Limitation of Liability
To the maximum extent permitted by law, Rovly and its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, service interruption, device damage, caffeine choices, equipment misuse, brewing results, hot-water injuries caused by your conduct, or substitute services arising out of or related to the Service or this Agreement.
To the maximum extent permitted by law, Rovly's total liability for any claim will not exceed the greater of the amount you paid to Rovly through the Service during the three months before the event giving rise to the claim or USD $50.
18. Indemnity
You agree to defend, indemnify, and hold harmless Rovly from claims, damages, liabilities, losses, costs, and expenses arising from your User Content, your use of the Service, your brewing choices, your violation of this Agreement, your violation of law, or your violation of third-party rights.
19. Termination
You may stop using Rovly at any time. We may suspend or terminate your access if we believe you violated this Agreement, created risk or legal exposure, abused other users, posted objectionable content, misused the Service, infringed rights, or engaged in unlawful or unsafe conduct.
Upon termination, your license ends immediately and you must stop using the app and Service. Sections that by their nature should survive termination will survive.
20. Export Compliance and Government Users
You may not use, export, re-export, import, or transfer the app or Service except as authorized by applicable laws. You represent that you are not located in a country or region subject to a U.S. government embargo and are not listed on any U.S. government list of prohibited or restricted parties.
The app and related documentation are commercial items and are licensed to U.S. government end users only with the rights granted to all other users under this Agreement.
21. Changes, Governing Law, and Contact
We may modify the Service or update this Agreement from time to time. If we make material changes, we may notify you through the Service, by email, or by other reasonable means. Your continued use of the Service after an updated Agreement becomes effective means you accept the updated Agreement.
This Agreement is governed by the laws of the jurisdiction selected by Rovly, except where applicable consumer protection laws require otherwise. Nothing in this Agreement limits rights you cannot waive under local law.
